Jakarta, CNBC Indonesia – Artist Furry Setya, who stars as the character Mas Pur in the soap opera Tukang Ojek Pengkolan, was recently reported to be divorcing Dwinda Ratna. Reportedly, there are no claims for shared assets in the divorce process, but Mas Pur has given Winda a new house.

As reported by InsertLive, Furry gave the house before the divorce. And the giving process is documented on his personal YouTube account entitled “Dream Home Gift.”

“I have one house and it was given to Winda in the Ciputat area, I’m in the Cinere area, it doesn’t include mutual assets, just share it normally, in my divorce clause there is no mutual benefit, I try to make it fair,” said Furry Setya, as quoted second.

It could be said that the divorce of a couple who married in December 2018 was almost unnoticed by the media.

Learning from Furry and Winda’s divorce case, the house assets Furry gave could actually be classified as mutual assets if the purchase was made after they were married, provided that the two couples did not have a prenuptial agreement.

As is known, Article 35 of the Marriage Law divides marital assets into three types.

The first is inherited assets or assets that existed before the marriage took place.

For example, the wife already owned a house before marriage, or the assets could also be in the form of assets obtained from the inheritance process. The house is the wife’s inherited property and the husband cannot interfere with the property.

The last one is joint assets. This is actually what is often called mutually beneficial assets when a divorce occurs.

These assets are assets accumulated during marriage due to the husband’s or wife’s business or work during the marriage.

It is possible that, when someone has household savings, buys a house, or other assets at the time of marriage, these assets are ultimately claimed as joint property. And when a divorce occurs, this becomes a matter of dispute.
