Hana Hanifah sues husband for divorce, must dowry be returned? My Money – 2 days ago

Jakarta, CNBC Indonesia – FTV artist Hana Hanifah suddenly went viral after reportedly suing her husband, Randy, for divorce at the Bogor court. Even though their marriage had only been going on for a month.

As reported second, Hana’s reason for suing her husband for divorce began when they performed the Umrah pilgrimage some time ago. Hana had said that she wanted to take care of her mother who was sick after returning from Umrah, but it was thought that Randy did not like the plans that his wife wanted to carry out.

When he returned from Umrah, Randy left Hana Hanifah and her family at the airport and went home first. This made Hana Hanifah feel hurt.

After an argument broke out, Randy asked to return the dowry he had given to Hana Hanifah.

Hana’s lawyer, Acong Latif, said that based on the Marriage Law, the dowry that has been given to the wife cannot be taken back because it is entirely the wife’s right.

Here are some reviews about dowry that you should know when your wife files a lawsuit.

Wife sues for divorce, dowry is not required to be returned

According to Article 32 of the Compilation of Islamic Law (KHI) which is stipulated through Presidential Instruction No. 1 of 1991, “The dowry is given directly to the prospective bride and since then it has become her personal right.”

So that means that the dowry that Bekti gave to Hana will be completely Hana’s right, because the gift was made before the marriage was valid, or during the consent process.

Reporting from an article on the Online Law site, a Lecturer in Islamic Law at the Faculty of Law, University of Indonesia (FH UI) explained that because the dowry is the wife’s right, the wife is not obliged to return the dowry. This is because the obligation of the wife who filed the lawsuit is to pay the agreed ransom (iwad).
